These Terms of Service apply to galleries provided by Memo Torres Photography, including services offered under Fantastic Caos, Fantastic Pets, Fantastic Stage, Fantastic People and related photography services.
1. Gallery access
Client galleries are provided for viewing, selecting, downloading and, where applicable, purchasing photographs. Gallery links, passwords and download PINs are intended for the client and any persons with whom the client chooses to share them.
Clients are responsible for keeping private gallery passwords and download codes confidential.
2. Copyright and ownership
Unless otherwise agreed in writing, all photographs remain the intellectual property of Memo Torres Photography.
Purchasing a photography service, print or digital image does not transfer copyright ownership to the client.
Clients may use delivered photographs for personal use and personal social media unless another licence has been agreed in writing.
Commercial use, resale, redistribution, alteration for commercial purposes, or claiming authorship of the photographs requires prior written permission.
Photographs may not be used to train artificial intelligence models, create datasets, generate derivative AI content or for similar machine-learning purposes without prior written permission.
3. Downloads and image quality
Where digital downloads are enabled, clients are responsible for downloading and securely storing their delivered files.
Memo Torres Photography cannot guarantee permanent storage of galleries or photographs after the stated gallery availability period.
Images displayed online may be resized or compressed for web viewing and may differ from the final high-resolution files.
4. Editing and alterations
Final photographs are delivered according to the photographer's editing style.
Clients may crop or resize photographs for normal personal use and social media. Heavy filters, AI-generated alterations, extensive retouching or modifications that substantially change the original work should not be presented as the photographer’s original edit.
Additional retouching or specialised edits may be available for an additional fee.
5. Public and private galleries
Some galleries may be public, while others may be protected by passwords or client-exclusive access.
Clients should not assume that a gallery is private unless this has been specifically stated or access restrictions have been enabled.
6. Third-party sharing
Clients are responsible for any gallery links, passwords or photographs they choose to share with other people.
Memo Torres Photography is not responsible for further distribution by individuals who have received authorised access from the client.
7. Availability and technical issues
Gallery availability may occasionally be affected by maintenance, technical problems or third-party service interruptions.
Reasonable efforts will be made to restore access where possible.
8. Acceptance
By accessing and using a gallery, you agree to these Terms of Service.
